Toys For Kids ALL Participants agree to: *

- Accept responsibility and accountability for quality and professional competence, avoiding even the appearance of professional impropriety; - Conduct professional affairs in a manner which will avoid any exploitation of, or embarrassment to, themselves, TFKs, and/or TFKs members & affiliations; - Treat members and families with respect and impartiality, respecting differing beliefs and backgrounds; above all, clients should be allowed every opportunity to retain their personal dignity; - Commit professional leadership to the achievement of the highest level of service to the project; - Conduct the execution of project initiatives with respect for existing relationships within the network; maintain/respect the scope of ongoing, existing initiatives; - Manage information and preserve confidentiality gained through professional relationships in a responsible manner; while sharing of project engagement, strategies, and ideas is a critical aspect of networking, the right to control the use of its original materials must be respected. Within the bounds of the code of conduct, TFKs participants agrees to: - Assist in maintaining the integrity and competence of the projects and participants; - Assist in preventing unlawful, unauthorized, and dangerous practices; - Preserve the confidences of members, partners, and participants; - Advocate on behalf of the project and the families we serve within the bounds of the law; - Assist in improving the quality of life for the family participants.

I acknowledge and affirm that my Conduct and Behavior will align clearly with the define Code of Conduct stipulated in the above that I have read and understand. If I am unable to conduct myself within the manner defined; I will be asked to step away from any position assigned immediately.

Waiver & Release of Liability *

In return for being allowed to participate in ANY of the Annual Toys For Kids activities, including any activities incidental to such participation (“Volunteer Activities”), the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) agrees to release and hold harmless the Annual Toys For Kids project, City of Houston, HoustonFirst, or TFKs’ officers, directors, employees, sub-contractors, sponsors, agents and affiliates from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the activities wherever, whenever, or however the same may occur. I understand and agree that the Toys For Kids project are not responsible for any injury or property damage arising out of the activities, even if caused by their ordinary negligence or otherwise. I understand that participation in the activities involves certain risks, including, but not limited to, serious injury and death. I am voluntarily participating in the activities with knowledge of the danger involved and I agree to accept all risks of participation. I also agree to indemnify and hold harmless the Toys for Kids project for all claims arising out of my participation in the activities. I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect. I also acknowledge that the Toys For Kids project have not arranged and do not carry any insurance of any kind for my benefit or that of ALL participants, including but not limited to, Volunteers (if Volunteer is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors and assigns. I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in activities. I also understand that this document is a contract which grants certain rights to and eliminates the liability of the Toys For Kids project and all affiliates. Please note the signature authorize full permission as a participant for any and all photographs and videos may be used to promote and showcase the event and organization. Any and all portion of those medians may be used for public view and release any liability arising from the use of any said footage, video tape, and/or interview. All minors must be accompanied with parental permission liability release form.

I am of legal age and am freely signing this agreement. I have read this form and understand that by signing this form, I am giving up legal rights and remedies. If participant is underage, I am the parent or legal guardian of the participant, and I am of legal age and am freely signing this agreement. I have read this form and understand that by signing this form, I am giving up legal rights and remedies.

I certify that all information I have provided in order to apply for and secure a participant position with the Toys For Kids project is true, complete and correct, and I understand that any information provided by me that is found to be false, incomplete or misrepresented in any respect, will be sufficient cause to (i) cancel further consideration of this application, or (ii) immediately discharge me from serving as a vendor.
